Malam El-Rufai asks court to quash DSS charges

Malam Nasir El-Rufai has filed an application to quash the charges the DSS filed against him for being incompetent, for disclosing no offence known to law, and for constituting a gross abuse of court process. The court filing was made in response to Charge Number FHC/ABJ/CR/99/2026 instituted against Malam El-Rufai at the Federal High Court. The matter is scheduled for 25th February 2026, before Justice Joyce Abdulmalik.

El-Rufai’s motion on notice is praying the court for the following reliefs:
An Order quashing and/or striking out Charge No. FHC/ABJ/CR/99/2026 (as contained in the charge dated 16th February 2026) for being incompetent, for disclosing no offence known to law, and for constituting a gross abuse of court process.

An Order discharging the Defendant/Applicant on the ground that the charge discloses no prima facie case against him.

An Order awarding the sum of N2,000,000,000.00 (Two Billion Naira) only as costs against the Department of State Services (acting through its prosecuting counsel) for the abuse and misuse of the court process, and the egregious, reckless, and unconstitutional misuse of the criminal justice system to harass, embarrass, and publicly victimize the Defendant/Applicant.

El-Rufai’s motion, which cites 17 grounds for seeking the dismissal of the charges, was filed on 17 February 2023. His lawyers notified the Director General of the DSS of the processes that they have filed in the matter via a letter dated 18th February. The letter also formally informed the DSS regarding the legal representatives of Malam El-Rufai, and the names and address of his team of counsels.

The grounds cited in the motion seeking the dismissal of the charges include: their constitutional invalidity, lack of disclosure of a prima facie case, citing offences not known to law and failure to meet statutory conditions. Insecurity: Lawyer Writes Tinubu, Seeks Withdrawal of Charges Against Abba Kyari

A legal practitioner and human rights activist, Adamu Kabiru Adam, has written to President Bola Ahmed Tinubu, calling on the Federal Government to review and withdraw the charges against Deputy Commissioner of Police, Abba Kyari, amid the country’s worsening security situation.

The letter, dated January 30, 2026, was also copied to the Attorney-General of the Federation and Minister of Justice, urging the Federal Government to exercise its constitutional powers under Section 174 of the constitution in the interest of national security.

Adam said Nigeria is currently grappling with one of the most severe security crises in its history, with increasing cases of banditry, mass murders, terrorism, mass kidnappings, and violent attacks, particularly across the northern part of the country.

He noted that thousands of Nigerians have been killed or displaced, while kidnapping-for-ransom has spread across highways, schools, farmlands, and residential communities, severely affecting social and economic activities.

According to him, despite increased security spending and several policy interventions, criminal groups continue to operate with confidence, in some instances imposing illegal levies on communities and overwhelming local security structures.

The lawyer argued that during the period Abba Kyari played a frontline role in internal security operations, incidents of insurgency and organised violent crime were comparatively lower, with notable and unprecedented operational successes recorded through intelligence-driven policing and rapid response strategies.

While reaffirming his commitment to the rule of law and due process, Adam maintained that the continued prosecution of Kyari at a time of national security emergency requires careful reassessment in the overriding public interest.

He cited Section 14(2)(b) of the 1999 Constitution (as amended), which states that the security and

Police Indict NDLEA Over Co***ne Seized from Drug Suspects arrested by Police IRT officers In Enugu Airport on 19/1/2022 and subsequently transferred to NDLEA on 25/1/2022

The Police Video expert who Video interviewed the drug Suspects Police IRT arrested and transferred to NDLEA (Defense witness 2) DW2 on Wednesday at the Federal High Court in Abuja indicted operatives of the National Drug Law and Enforcement Agency (NDLEA) over a 21.55kg of co***ne seized at the Enugu airport January 19th 2022 by officers of the Nigerian Police IRT after the drug Traffickers were cleared out of the Airport by conniving NDLEA officers on duty.

The indictment came when the 2nd defence witness DW2, John Nwonke, was led in evidence by the defence counsel to Abba Kyari, Dr Onyechi Ikpeazu SAN.

Others in the case are Sunday J. Ubua, an Assistant Commissioner of Police; Bawa James, an Assistant Superintendent of Police; Simon Agirgba, an Inspector; John Nuhu, also an inspector all from the Police IRT.

The witness, who described himself and presented a warrant ID and an office ID card as a member of the Nigerian Police stated that in the 20/1/2022 he was invited to the office of the Intelligence Response Team (IRT), He said being a trained professional Police Camera and Video expert, he was asked by the team lead ASP James Bawa, who led the team that arrested the two drug traffickers -- Chibunna Patrick Umeibe and Emeka Alphonsus Ezenwanne at Enugu Airport on the 19/1/2022 after the drug Suspects were cleared out of the Airport by the NDLEA Officers.

The Defence witness said, “I was told that they arrested and brought in Suspects with Suspected co***ne from Ethiopia to Nigeria, and that there is a need for him to conduct a Video interview on the drug Suspects.”

He explained before the presiding Judge, Justice Emeka Nwite, that he works with the police media and Public relations department and he has interviewed several Suspect

Reminder, Court to Hear Mazi Nnamdi Kanu’s Transfer Request Today, 27/01/2026

Today, Mazi Nnamdi Kanu Case is expected to appear before Justice Omotosho. The court will consider a request to transfer him from Sokoto Correctional Centre to Abuja, where he can access facilities necessary to properly pursue his appeal.

The court had previously ruled that he should not have access to electronic devices, which has affected the progress of his appeal. Today’s hearing will review these issues to ensure he can effectively continue his appeal process.

The outcome of the hearing is being closely followed nationwide.
