Lungu family trying to move body out of SA, government tells court

GOVERNMENT has told the Pretoria High Court in South Africa that the family of former president Edgar Lungu are allegedly trying to move his body from South Africa to another country.

Attorney General Mulilo Kabesha is therefore demanding that the body be returned to the South African Police Service (SAPS) so that investigations into the cause of death can be completed.

In an affidavit filed before the court, Kabesha said the matter was urgent and that the family, being foreign nationals have both the ability and motivation to move the remains.

He further warned the court that moving the body out of South Africa would have serious consequences for the government of Zambia.

"I respectfully submit that the matter is sufficiently urgent to be dealt with on the basis set out in the attached Nalice. The members of the Lungu Family are peregrini of this Court. They have the power (and motivation) to move the body of the late Presiden to outside the Republic of South Africa, and should they proceed to do so (which verily believe they are in the process of doing) they would cause the Government of Zambia irreparable harm, " wrote Kabesha.

Last Wednesday, the Pretoria High Court facilitated the handover of the former Head of State’s body to SAPS for investigation and a post mortem.

This followed earlier proceedings in which the Supreme Court of Appeal South Africa indicated that the Lungu family had failed to meet a March 30, 2026 deadline for filing heads of argument, resulting in their appeal being treated as lapsed.

Kabesha later clarified that the body would not be immediately repatriated to Zambia, as police were still conducting investigations into the circumstances surrounding Lungu’s death.

However, the court subsequently issued an urgent order directing that the body be returned to Two Mountains morgue, a decision which government is now challenging.

In fresh court papers, Kabesha argues that the family obtained that order without fully disclosing key facts to the judge, including existing court orders and ongoing legal processes.

He further told the court that police lawfully took custody of the body under the Inquests Act 1959 South Africa, which allows authorities to investigate deaths suspected to be unnatural and to conduct post mortems where necessary.

Kabesha also disputed claims that the body was being unlawfully repatriated, stating that it was instead held for investigation purposes and had been placed in a state facility under police control.

“This is an application for the reconsideration of an Order granted by the Honourable Judge Francis-Subbiah on 22 April 2026, " read the document.

"The Government of Zambia would not obtain substantial redress if the matter is heard in due course, I respectully submit. I respectfully submit that the Court Order granted ex parte in the absence of the Government of Zambia on 22 April 2026 in the urgent application, falls to be reconsidered and be set aside.

"Because the misrepresentations and omissions in the Founding Affidavit where deliberate (or at best the result of gross negligence on the part of the Lungu Family), the Government of Zambia seeks an order that the costs of the reconsideration should be paid by the Applicants on the attorney and client scale, with such costs lo include those consequent upon the employment: of two counsel."

Kabesha argued that the Lungu family had also taken the body to a different morgue, contrary to a July 2025 court order.

"The Lungu family did not instruct the SAPS to return the body of the late President to Two Mountains (who, as I have stated above, is obliged in terms of the 2 July 2025 Order to retain the body). The Lungu Family instructed the SAPS to surrender the body to a funeral parlour in the East Rand."

"I do not wish to disclose particulars of the funeral parlour because of the sensitivity of the matter and in order to ensure the continued safekeeping of the tale President's mortal remains, " he said.

"I respectfully submit that when they brought the urgent ex parte application, the Lungu Family did not observe the utmost good faith. This is first, because they failed to draw the attention of the Honourable Court to the fact that VFV Attorneys were awaiting receipt of the court papers and particulars of the hearing which Mashele Attorneys have failed to provide them with."

ECL'S BODY WAS NOT STOLEN, AN AGREEMENT WAS REACHED BY PARTIES - SOURCE

Information has emerged that a recent meeting held in South Africa at the State Department involving family, Government and the host country representatives, had reached an agreement for the late six Republican President to be buried in Zambia on 6th June, being his death anniversary.

Meanwhile, SABC reports tha the Zambian government has executed the August 2025 Gauteng High Court in Pretoria’s judgment that entitles the government to repatriate the remains of former Zambian President Edgar Lungu

Earlier, a family source told with KBN TV that the body of the late former President Edgar Chagwa Lungu had gone missing from a South African mortuary.

However, fresh information reaching us suggests that a meeting was recently held at the South African State Department where parties agreed to a burial of ECL in Lusaka on his death anniversary on 5th of June.

"It's not true that the body has been stolen. The parties involved know the truth. A meeting was recently held here in South Africa at the State Department with representatives from the family, the host country and Zambian Government. In that meeting, it was agreed that the late former President of Zambia should be buried in Lusaka on 5th June, 2026," a South African official close to the matter disclosed.

Perhaps what should be of contention is the manner in which the body was accessed and moved, the source said, insisting that all parties had agreed on the wayforward.

When contacted for a comment, Secretary to the Cabinet, Mr. Patrick Kangwa, who is the sole designated Government official to comment on the ECL matters, claimed ignorance of the development regarding the body.

"I'm not aware about that. I'm hearing it from you. I have been in long meetings," Mr. Kangwa told KBN TV.

Efforts to reach the ECL family lawyer and Spokesperson, Makebi Zulu, who was recently in South Africa, failed by press time.

A 24-YEAR-OLD man from Chadiza District has been sentenced to 30 years of imprisonment with hard labor for sexually abusing his eight-year-old cousin and infecting her with syphilis.

​Innocent Phiri sexually abused his cousin on multiple occasions until she was diagnosed with syphilis at a hospital.

Particulars of the offense are that Phiri, on unknown dates between January 1, 2025, and July 30, 2025, in Chipata District, unlawfully had carnal knowledge of the child.

​Phiri was convicted by the Subordinate Court and committed to the High Court for sentencing on one count of defilement.

He appeared before Chipata High Court Judge-in-Charge, Justice Kafunda.

​During the trial, the court heard that the victim's mother noticed her daughter was struggling to walk after returning from school.

The mother testified that she asked her daughter to remove her underwear and noticed blood and pus on her private parts.

​"At 14:00 hours, I took her to Kavumo Clinic. I was asked what the child had said, and I told them she had said nothing. I was informed the child had syphilis and was told to question her further. I did, but she did not respond at that time," she said.

The mother said that the child was given medication and later went for a review.

During that time, the child disclosed that Phiri had carnal knowledge of her.

The victim testified that the convict used to sneak into the room where she slept with two others.

​She further said that the convict would cover her mouth and threaten to kill her mother if she disclosed the abuse.

The victim told the court that she felt pain every time she was sexually assaulted and that Phiri continuously threatened her and her parents to ensure her silence.

​In sentencing the convict, Mr Justice Kafunda stated that the fact the convict infected the child with syphilis was an aggravating factor.

He imposed a 30-year prison sentence with hard labor, effective from the date of Phiri's arrest.

Police Assaulter Gets 3 Years at Chingola Correctional Facility

The Chingola Magistrate Court has sentenced a 23-year-old man of Kapisha to three years’ imprisonment with hard labour for assaulting a police officer on duty at the Nchanga open pit.

Edify Nasilele denied the charge, telling the court he was drunk on the day and could not remember anything that happened.

During trial, police officer Elma Zulu testified that she was deployed to Nchanga open pit with other officers when they received a complaint that a man was attempting to steal from a shop. She said they found the suspect being beaten by a mob and took him to the police tent for his safety.

While at the tent, the suspect became unruly. Zulu said she fired warning shots, but he continued misbehaving. When she tried to run, he chased her, causing her to fall. He then picked up a stone and struck her three times on the right leg, injuring her.

Another witness told the court how the suspect injured the victim with a stone while officers were trying to save him from an angry mob. The witness confirmed that the suspect was intoxicated during the incident.

In passing judgment, Chingola Magistrate Maybin Kapaya found Nasilele guilty and convicted him accordingly. He said the prosecution had proved beyond reasonable doubt that Nasilele assaulted the victim, adding that intoxication was not an excuse to commit such a crime, especially using a weapon.

In mitigation, Nasilele expressed remorse for the offence, said he regretted it, and asked the court to forgive him as a first offender.

Magistrate Kapaya said he had considered the mitigation and noted that the convict was youthful and deserved some leniency. However, he said the court had to send a warning to would-be offenders because many people think they can attack men and women in uniform.

He sentenced Nasilele to 36 months’ imprisonment with hard labour, effective January 21, 2026, the date of his arrest.

HH Arrives in Livingstone for EIZ AGM

President HAKAINDE HICHILEMA has arrived in Livingstone to officiate at the Engineering Institution of Zambia –EIZ- 69th Annual General Meeting and Symposium.

The President touched down at Harry Mwaanga Nkumbula International Airport at around 10:30 hours.

He was received by Southern Province Minister CREDO NANJUWA, Information and Media Minister CORNELIUS MWEETWA, and Tourism Minister RODNEY SIKUMBA.

Also present were Livingstone Mayor CONSTANCE MULEABAI, District Commissioners, Council Chairpersons, government officials, and UPND party leaders.

Shortly after arrival, President HICHILEMA interacted briefly with Livingstone residents, UPND supporters, and students who gathered in large numbers at the airport.
