Membership
• You may be a member of MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD if you are aged 18 years or over and have a current Australian residential address. To become a member, you must have purchased the card & complete the transaction at Mercato + Liquor located at 275 high stree
t Thomastown. No Personal details shall be collected from the customer under any circumstances and is valid only when the card is present for purchase.
• No additional member to an existing account is currently being offered
• Membership is valid for One Month, 5 Months or 1 year depends on customer choice while purchasing the same.
• Membership is $10 Per Month or $50 for 5 Months or $100 for One year, and under no circumstances we allow for issue or replacement card.
• By becoming a member you are entitiled to get a flat 10% discount on your bill excluding Tobacco & Liquor products for a period of either one Month, 5 Months or for 1 year from the date of your first transaction on your membership discount card.
• By becoming a member, you agree and acknowledge that information about your MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD account, including if any personal information you may opt provide to MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD, may be disclosed to all members on your MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD account.
• Always keep your receipt for your Membership Discount Card. Your obligations
• Using or quoting your MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD during a transaction or registering with MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD in accordance with 1.1 above constitutes acceptance of these Terms and Conditions.
• It is your responsibility to inform us if:
o Your personal details change, if provided (including, but not limited to, your address, email address or phone number). If we do not have your correct details, we may not be able to contact you about your account or send you offers or rewards, and we may also restrict operations on your account (such as special offers). o Loss of card. o You would like your details removed from the account.
• MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD cards are not credit or charge cards, are not transferable, not exchangeable and remain the property of MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD./ remains the property of Msquare Retail Pvt Ltd.
• You may terminate your membership at any time and for any reason by contacting us, provided you are the member who initiated the MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD account & such termination would not provide you with a refund of exchange of cash you have paid while purchasing the membership discount card. Claiming Discount
• Discount shall be reflected in your each receipt after you have done transaction at Mercato + Liquor located at 275 high street Thomastown on a Qualifying Transaction by using your MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD. We are not responsible if for any reason the card was not presented during the transaction. Discount cannot be claimed after the transaction is done and the payment has been made.
• Discount may also be not valid for a return or exchange or faulty products or free samples/offers.
• We may correct erroneous, invalid discounts or adjust for reversed transactions at any time
• MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD do not collect any of your personal data, or keep track of your spend of keep track of the value of discount you have gained by using the card and hence each transaction is deemed independent and cannot clubbed together with or under your discount card.
• You cannot transfer, sell, or give your Membership discount card to any other person.
• MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD has no cash or monetary value. Rewards
• Flat 10% for the specific period of time you have been authorized to use the card at the time of your purchase.
• All discounts are subject to availability. We are not responsible to you if any reward is not available due to specific reason. General
• We may, in our discretion, make any change we see fit to these Terms and Conditions, including, without limitation:
o the range of Outlets and Qualifying Transactions;
o the discount you can earn on Qualifying Transactions;
o the range of products and the percentage of discount;
o the period for expiry of existing or future cards or MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD validity in your account.
• We will give you notice of any change to the Terms and Conditions or as set out in 5.1, at our sole discretion:
o via the MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD website/ facebookpage ; and/ NOT
o by direct communications sent to members. No member personal data is collected and hence no personal information or any sort shall be shared via us.
• In addition to the right to terminate in 3.6, we may terminate your MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD membership immediately and without notice where you:
o fail to comply with these Terms and Conditions;
o provide misleading information or make any misrepresentation to us or to any Participant in connection with MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD;
o are abusive or offensive to any of our or our Participants' staff
• Where your MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD membership is terminated, all members on your MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD account will cease to be entitled to redeem discount and your account will be deleted.
• Respecting your personal information is very important to us. The MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD DO NOT COLLECT ANY PERSONAL INFORMATION OF ANY MANNER.
• We will not be liable to you for the termination of the MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD program for any reason whatsoever.
• Any liability we may have to you in negligence, breach of contract or otherwise, and all conditions and warranties as to the condition, suitability, quality, fitness or safety of any goods or services supplied by MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD whether express or implied by statute, are excluded to the extent permitted by law, and, where liability cannot be excluded, our liability to you will in all cases be limited to
o the cost of re-supplying the goods or services or repairing, or paying the costs of repairing, the goods;
o reinstating the discount ; or,
o Where the dispute relates to a discount, the actual difference of disputed discount amount.
• Any tax, liability, or duty incurred by a member arising from a member's participation in the MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD program is the responsibility of the member.
• Nothing in these Terms and Conditions limits your rights under the Australian Consumer Law.

MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD
means you get a flat 10% discount on all your transactions excluding Liquor & Tobacco transactions, which shall be eligible when you present your MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD on transactions at the Participants who offer this reward facility. Participant
means those companies (and other persons) who have agreed with us to give flat discount of 10% to MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD members under the MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD program for a specific set of period / tenure defined by yourself at the time of purchase. Qualifying Transactionmeans a transaction with a Participant for goods or services on which the Participant issues discount. Related Bodies Corporatehas the same meaning as in the Corporations Act 2001. Service Centremeans the call centre operated by or on behalf of us for the purposes of the MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD program. Terms and Conditionsmeans this document, and any other documents referred to in it.
“You”means, unless these Terms and Conditions indicate otherwise, each MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD member, including any additional members, on a MSQUARE MERCATO MEMBERSHIP DISCOUNT CARD account.
