These terms and conditions (together with the documents referred to in them) (the "Terms") set out the terms and conditions on which we supply any of the products ("Products") listed on Facebook www.facebook.com/torbayhangoverfairies. By placing an order for Products you agree to be bound by these Terms. Please read them carefully before doing so. WE ARE THE LOCAL OUTLET OF TORBAY HANGOVER FAIRIES FOR YOUR POSTCODE AREA. OUR DETAILS ARE SET OUT ON FACEBOOK. ANY CONTRACT ENTERED INTO FOR THE DELIVERY OF PRODUCTS WILL BE BETWEEN YOU AND US.
1. The price of the Products will be as quoted over the phone or by text at the time you confirm your order. If we have by obvious mistake underpriced any Product, we will not be liable to supply that Product at the stated price. We will endeavour to notify you before despatch. If you subsequently amend your order, the prices charged will be those applicable to the amended Products at the time that you confirm your amended order.
2. All prices are expressed inclusive of any VAT payable (unless otherwise stated) at the current rates and are correct at the time of ordering.

2. SERVICE AVAILABILITY
1. Our page is only intended for use by people resident in Torbay, Devon. Some restrictions are placed on the extent to which we accept orders from specific regions. These restrictions can be found on our page. Please review our page before ordering Products from us.
2. We may accept orders from individuals outside these regions for delivery at a delivery address compatible with our delivery schedule (as amended from time to time). However, to the extent that you place an order for Product(s) outside this region, we shall not be liable to you, or any third party in respect of such orders.
3. PAYMENT
1. Payment for Products may be made by:

2. Payment by cash will be collected at the point of delivery unless an alternative method of payment has been agreed by us BEFORE delivery.
8. You agree to indemnify us in full against all loss, cost and expense incurred by us or our agent in obtaining payment from you in the event that we are unable to recover in full the price of any Product ordered by you.
4. AVAILABILITY
1. We will notify you as soon as possible if for any reason we are unable to supply a particular Product. We will not be liable to you if we are unable to supply a particular Product. We will try, where appropriate, to offer a substitute but please note that this may affect the price. You may reject any substitute Product and we will refund the amount you have been charged for that substitute.
2. Although we will always try to cater for your order, an order of large quantities of a particular Product can only be fulfilled at our discretion.
5. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
1. After placing an order by phone or text, you will be advised of confirmation at the time of booking. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us. The contract between us ("Contract") will only be formed when confirmed by our Head Office.
2. The Contract will relate only to those Products whose dispatch we have confirmed.
6. DELIVERY / RISK AND TITLE
1. The waiting time for any order is a guideline only and is provided by Torbay Hangover Fairies solely for the convenience of the customer. Torbay Hangover Fairies under no legal obligation to meet this approximate waiting time.
2. Delivery will be made to the address given when ordering.
3. We reserve the right to restrict deliveries in certain areas and this includes the right to eliminate certain areas from our delivery schedule entirely from time to time.
5. The Products will be at your risk from the time of delivery.
7. CANCELLATION AND CHANGES TO AN ORDER
1. There will be no cancellation policy and all orders must be paid for.
2. If we have sent an incorrect item, please notify us as soon as possible. If you would like us to replace the incorrect item with the item that you ordered, we shall send you the correct one as soon as possible. We will not charge you for the incorrect item.
8. AMENDMENTS TO Facebook
1. We reserve the right to alter or withdraw any Products from Facebook at any time and/or remove or edit any material or content on Facebook and will not be liable to you or any third party by reason of our altering or withdrawing any Product whether or not that Product has been sold or by reason of removing or editing any material or contents of the Website.
2. We may update these Terms from time to time. Any changes will be notified to you via Facebook. If you do not wish to accept the new terms and conditions you should cease using this page. If you continue to do so, after the date on which the changes come into effect, your use will indicate your agreement to be bound by the new terms and conditions.
9. REGISTRATION
1. To be eligible to purchase Products from Torbay Hangover Fairies you have stipulated a delivery address compatible with our delivery schedule, as amended from time to time.
2. We process information about you in accordance with our Privacy Policy. By using Torbay Hangover Fairies, you consent to such processing and you warrant that the details provided by you are true, accurate, current and complete in all respects. You must notify us immediately of any changes to the information that you have provided by updating your personal details.
3. You are responsible for any activity or order that occurs or is submitted.
10. OUR RIGHT TO REFUSE A TRANSACTION OR TO SUSPEND OR CANCEL YOUR REGISTRATION
1. We reserve the right to refuse to process a transaction to any customer and we shall not be liable to you or to any third party for refusing to process a transaction or unwinding or suspending any transaction should the processing have begun.
11. EVENTS OUTSIDE OUR CONTROLS
1. We will not be liable or responsible for any failure to perform, or delay in performance of any of our obligations that is caused by events outside our reasonable control ("Force Majeure Event").
2. A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
12. MISCELLANEOUS
1. If you breach these Terms and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Terms.
2. If any part of these Terms is found to be invalid, unlawful or unenforceable to any extent by any court having competent jurisdiction, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
3. These Terms and any document expressly referred to in them constitute the whole agreement between us and supersede any previous arrangement, understanding or agreement between us, relating to the subject matter of any Contract. The parties acknowledge that they have not entered into these Terms in reliance upon any statement, representation, assurance or warranty which is not set out in these Terms. Nothing in this paragraph shall limit or exclude any liability for fraud.
