Section 40 of the Waqf Act, 1995, deals with the powers of the Waqf Board to decide whether a property is a Waqf property or not. Specifically, it states that:

- The Waqf Board has the power to determine whether a property is a Waqf property or not.
- The Board can conduct inquiries and investigations to determine the nature of the property.
- The Board's decision is final and binding, subject to appeal to the Tribunal.

In essence, Section 40 gives the Waqf Board the authority to:

- Identify Waqf properties
- Determine the extent and boundaries of Waqf properties
- Resolve disputes related to Waqf properties

By omitting Section 40, the proposed amendment aims to take away the Waqf Board's power to decide on the status of a property, potentially giving more control to the government or other authorities. This has raised concerns among Muslim leaders and communities, who fear it may lead to the loss of autonomy and control over Waqf properties.
