Courts have variously held that costs follow the event.in the case of Albert canale versus Giovanno Gremmo & another Malindi HCCC No.58 of 2006,the court held that under section 27(1) of the Civil Procedure Act, Costs must follow the events.

Further in the case of Gavuli Clearing and Forwarding Limited versus Charles Kalujee Lwanga Nairobi HCCC No.583 of 2006

The court held that;

‘under section 27 of the Civil Procedure Act, the court has wide discretion to make orders in respect of costs’’
