Usa ka bag-ong giya gikan sa Korte Suprema naghatag og mas klarong direksiyon sa mga kaso nga naglambigit og malaswang binuhatan batok sa mga menor de edad. Sa yano nga pagsabot, giingon sa Korte nga dili tanan kaso nga parehas og hulagway sa facts, parehas dayon og ikasang-at nga kaso. Importante gyud nga tan-awon unsa gyud ang pamaagi sa pagbuhat sa akusado, pila ang edad sa biktima, ug unsang balaod ang tukmang mohaom sa sitwasyon.

Firstly, kung ang biktima kay menor nga naa na sa edad nga lapas sa kinse apan wala pa moabot sa disiotso, mahimong mosulod ang balaod sa proteksiyon sa kabataan ilalom sa RA No. 7610, ilabi na kung ang pag-apil sa bata nakuha pinaagi sa pagpugos sa hunahuna, pagmaniobra, pagpahimulos sa impluwensiya, o paggamit og kahimtang nga makapahilom o makapaluya sa bata. Sa ato pa, dili kinahanglan pirmi nga adunay kusog nga pwersa aron mahimong kaso ilalom niini.

Ang giya sa Korte nagpasabot nga sa ubang sitwasyon, depende sa edad ug sa eksaktong gibuhat, ang kaso mahimong motipas ngadto sa r**e o acts of lasciviousness ubos sa Revised Penal Code. Busa, dili pwede nga pasagad lang ang pagpili sa kaso kay dakong butang kini sa hustong pagpanalipod sa biktima ug sa hustong pagsilot sa nakasala.

Sa usa ka kasong gitan-aw sa Korte, nakita usab nga usahay kulang ang kasamtangang porma sa balaod aron matumbasan ang kabug-at sa gibuhat nga kalapasan. Bisan pa niana, giingon sa Korte nga ang trabaho sa hudikatura mao ang pagpatuman sa balaod sumala sa gisulat niini, ug dili ang pag-usab sa silot aron mas mopasangil sa kasuko sa publiko. Sa laktod nga pagkasulti, ang pagpauswag o pagpabug-at sa silot trabaho na gyud sa Kongreso, dili sa Korte.
