Day 135: Proving the Negative—Drafting the Willfulness Memorandum behind Bars. If you are operating openly, responding to takedowns, and navigating the unsettled legal reality of Orphan Works, how does the state manufacture "willfulness"? They do it by ignoring the DOJ’s own Justice Manual.

The Cup N**i didn’t like our pre-prepped cups. He dictated only four ahead, even if it meant the entire cafeteria line backed up. Bureaucracy over efficiency—a perfect metaphor for the "Copyright Regime" we fight today. My response? The same response I had in FMC Devens: "Cereal. Stay focused on the cereal." It’s an ongoing Zen statement that reminds me why I sacrificed everything to fight the systematic destruction of creative intent.

US v Gordon "The Orphan Works Trial" In a Fair Use case, the physical container is irrelevant to the legal status of the content. If the work is an Orphan Work (the copyright holder has abandoned the market), providing it in a paper sleeve doesn't make it "counterfeit"—it makes it an archival copy... https://bit.ly/41xIzvK

I’m published these transcripts not just as a record of my case, but as a case study in how the 'Grey Fog' of Fair Use is treated in a criminal courtroom. By turning these days of testimony into accessible volumes, I am ensuring that the arguments for Orphan Works—which the prosecution tried so hard to suppress—are preserved in the public square. If the law won't recognize the value of saving lost media, then the public should at least see how the government spent five years and millions of dollars to stop it.
