Here we go again
This is not the post I expected to make on this Monday- for the second time this year.
As many of our long standing followers know, in May of this year, Bonneville County zoning gave us notice that farmstands (citing the “regular sale of goods” from a property) were not permitted in Bonneville county and we needed to shut down. We complied, closed our doors for a few weeks- and then we were directed to state laws that claim otherwise.
Idaho’s Direct to Consumer Commerce Act was updated this spring, with a defined goal to minimize regulatory burden and encourage the expansion of direct sales within the state between producers to consumers. The bill defines “Farmstands,” and has a preemption paragraph that states that uniform laws throughout the state regarding the production, sale, and acquisition of products is necessary to promote our economy, and that all local rules, ordinances, laws, regulations, and policies that contradict this law are declared unenforceable.
We submitted that law to the Bonneville zoning office. We posted the law on our doors and reopened. We got 2 emails from zoning stating “we’re reviewing, we’ll get back to you-“ 2 weeks in a row and then, crickets.
We assumed the matter was settled. We assumed, they must have realized they were in the wrong with the updated law and dropped the topic. Our last contact was June 5th.
And then over this weekend, we received a notice in the mail.
Shut down by Tuesday, September 1st- or start getting fined.
$100 the first day. $200 the second day. $300 the third. $400 the fourth. $500 the fifth. If we remain open they’ll continue fining higher each day and if we don’t pay it they’ll put a lien on our home.
How do they just completely fail to respond to a state law, and then give us one singular business day to resolve this before AGAIN, taking away our livelihood?
The potential gray area we were all questioning is if they’re claiming the wording in the law only applies to agricultural zoning areas. But it’s a little silly to me that we’ve come down to this, and that if that was the issue they’re claiming, they didn’t respond with an email stating that directly.
Through all of this, I’ve actually remained more positive this time. We will find a resolution and we won’t give up this fight. We love our community and if we learned anything from last time- it’s that we have an AMAZING local support system. You all are WONDERFUL and we wouldn’t be here without you ❤️❤️❤️
Here’s what this week will look like:
Today- open as usual! We baked for a typical Monday, come by while goodies last! If you want to stock up on easy grab jams/pancake mixes/ect, do so while they’re still out in front of the house. I’ll be spending my day hoping to hear back from our county commissioner and figure out our next steps.
We’ll be closed Tuesday as usual- that’s our day “off.” So we’ll spend that day sorting out where we’re landing.
After today- if we cannot find an immediate resolution to this location- we will either move the farmstand to a temporary location or schedule more pop up/ preorder locations!! Do not fret- I will not stop baking! It’s just a pain that they’re making us all jump through hoops to get there. I’m sad for all my local dog walkers, kids on bikes, and moms with strollers who make our farmstand a casual, fun part of their day.

I’m going to take this step by step- give me a day to sort out this silly and I’ll have a better game plan. Stay tuned for updates, I’ll give them as I have them.
